Terms of service
Terms of service
These terms cover your use of themadtag.com and any order you place with MADTAG. We are based in Queensland, Australia, and we sell worldwide. Placing an order means you accept them.
1. What we sell
MADTAG is a gallery. We show work by independent artists, we name them, and we print their work on metal, in a frame, on archival paper or on canvas, once you buy it. We also take on custom and commissioned work in Australia.
2. Orders
Your order is an offer to buy. It is accepted when we send you an order confirmation. We may cancel and refund in full before a work goes into production, for example where a price or description is obviously wrong, where a work has been withdrawn by its artist, or where we cannot lawfully ship it to you.
3. Prices
Prices are shown in the currency of the country you are shopping from. Any tax that applies there is shown at checkout before you pay. Shipping is free everywhere, and we cover the import duty on the few routes where a work crosses a border. Prices change from time to time. The price you pay is the price shown when you order.
4. What arrives
Screens and room images are a close guide, not an exact promise. Colour shifts a little between a screen and a print, and no two prints are identical to the last decimal, which is ordinary in printing rather than a fault. Anything visibly wrong is covered by our Returns and refunds page, and by the consumer law where you live.
5. Returns, refunds and delivery
Our Returns and refunds page and our Shipping page form part of these terms.
6. The artwork
Every work is used with the permission of the artist who made it, or comes from a source we are entitled to print from, and we keep a record of which. Buying a print buys you the print. It does not transfer copyright, and it does not licence you to reproduce, resell as a reproduction, or make derivative work from the image. Hang it, move it, leave it to someone. That is what it is for.
The MADTAG name, wordmark and site are ours. Nothing here grants you a licence to use them.
7. Custom and commissioned work
If you send us artwork, a logo or a photograph, you confirm you own it or have permission to have it printed. You are responsible for any claim that says otherwise. We can decline artwork, including anything that looks like it infringes someone's rights or that we would not want to put our name to, and if we decline after you have paid, we refund in full. Where your order involves a proof, production starts when you approve it, and an approved proof is final.
8. Consumer law and liability
Nothing in these terms excludes or limits a right you have under the law where you live that cannot be excluded. In Australia our goods come with guarantees under the Australian Consumer Law. Beyond what the law requires, our liability for any claim about an order is limited to remaking the work or refunding what you paid, at our choice, and we are not liable for indirect or consequential loss.
9. The site
We work to keep the gallery accurate and available, without promising it will never be wrong or never go down. We may change or withdraw any part of it.
10. Changes
We update these terms from time to time. The version published here when you order is the version that applies to your order.
11. Law
These terms are governed by the law of Queensland, Australia, and its courts have non-exclusive jurisdiction. If you bought as a consumer somewhere else, this does not take away the protection of the mandatory consumer law of your own country.
